ACCEPTANCE OF TERMS
These terms and conditions govern all supply of goods and services ("products") by Eyecatcher Arts ("Eyecatcher Arts", "we", "us") to you, the purchaser of goods and services from us, including your use of the Artkart online shop ("the website"). They are effective from 10 April 2026 and replace all earlier Eyecatcher Arts terms of trade.
We reserve the right to change these terms by posting revised terms on our website. By continuing to use the website after changes are posted, you accept the revised terms.
To make a purchase from our online shop you must be 18 years of age or over.
Purchases may only be made by persons acquiring goods for their own use or consumption. You must not acquire goods from us for resupply or commercial purposes.
If you are purchasing on behalf of a company or other entity, you warrant that you have authorisation to agree to these terms on behalf of that entity.
AVAILABILITY AND SUPPLY
All orders are subject to the availability of products. If a product is not available we will endeavour to notify you of the non-availability as soon as possible.
PRICING
All prices are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) unless stated otherwise. Prices are exclusive of delivery charges. All prices are correct when published and we reserve the right to alter prices at any time.
An invoice will be emailed to you at the address you supply when placing your order. You are responsible for ensuring your contact details are correct.
PAYMENT OPTIONS
We accept payment via PayPal and direct bank transfer. Payment details will be provided at checkout.
For direct bank transfer orders, goods will be dispatched once payment has been received and confirmed in our account.
DELIVERY AND DELIVERY CHARGES
We deliver Australia-wide via Australia Post. Delivery charges are calculated at checkout based on your location and order size.
We will endeavour to dispatch all orders within 3–5 business days of receiving payment. Delivery times will vary depending on your location. We are not responsible for delays caused by Australia Post once an order has been dispatched.
We only deliver to Australian street addresses. We are unable to deliver to PO Boxes.
RETURNS AND REFUNDS
We do not provide refunds for change of mind purchases, so please choose carefully.
If a product is faulty or damaged, please contact us at [email protected] within 14 days of receiving your order. We will ask you to return the item by post — we will refund your return postage costs — and we will either send you a replacement item or provide a full refund for the item, at your choice.
Your rights under the Australian Consumer Law are not excluded by these terms. If goods are faulty, we will meet our obligations to provide a remedy under the Australian Consumer Law.
LIABILITY LIMITATION
We will always endeavour to have complete and accurate information on our website, but to the greatest extent permissible by law we assume no responsibility for the completeness or accuracy of information provided.
To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. Our maximum liability to you (if any) shall be limited to the value of the faulty products or services supplied by us.
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law which cannot lawfully be excluded or limited.
APPLICABLE LAW AND JURISDICTION
These terms and conditions are governed by the laws of New South Wales, Australia. The courts of New South Wales shall have non-exclusive jurisdiction over all claims or disputes arising in relation to these terms, the use of our website, or the supply of any products or services.
PRIVACY POLICY
We collect personal information from you when you place an order. This information is used to process your order, administer payments and contact you about your purchase.
We will not contact you for marketing purposes unless you have opted in to receive communications from us. You may opt out at any time by contacting us at [email protected] or following the unsubscribe link in any email we send.
We may use cookies on our website to enable certain features. Where you choose not to enable cookies, some functionality may not be available.
We may disclose your personal information as required by law. You can request details of the personal information we hold about you and ask us to correct it at any time.
GENERAL CONDITIONS
We reserve the right to change these terms from time to time by posting updated terms on our website.
If we fail to enforce any term or exercise any right at any time, this does not constitute a waiver of those rights.
If any provision of these terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
We may deliver notices to you by email to the address you have provided to us.
